Volume remains tightly bound, as would be expected in an unread book. On the bright and sunny Sunday afternoon of January 30, 1972, British paratroopers in Derry, Northern Ireland, using high-velocity rifles, fired and shot 26 unarmed civilians during a protest march against internment without trial. 14 people died. Many of the victims were shot while fleeing from the soldiers, and some were shot while trying to help the wounded. Other protesters were injured by shrapnel, rubber bullets or batons, and two were run down by military vehicles. All of those shot were Catholics. This same military battalion was involved in two other controversial shootings: the Ballymurphy massacre several months earlier and the killing of Protestant civilians several months after. Parliament immediately demanded an inquiry. The Lord Chief Justice of England, Lord Widgery, conducted hearings, and the results were made public on April 18, 1972. While describing the soldiers' actions as “bordering on the reckless,” Lord Widgery, no doubt under pressure from the military, cleared the shooters of criminal wrongdoing. The report was branded an outlandish whitewash. Even the Derry coroner called the deaths “unadulterated murder.” In the years that followed, journalists, lawyers, and human-rights investigators largely demolished Lord Widgery's report piecemeal. Samuel Dash (d. 2004) was widely known for his role as chief counsel to the U.S. Senate Watergate Committee (1973-74). A former trial attorney, district attorney, and federal prosecutor, Dash was a well respected professor and director of the Institute of Criminal Law at Georgetown University. At the request of the International League for the Rights of Man [now “for Human Rights”] for an unbiased and comprehensive review, he and two other lawyers traveled to Northern Ireland to investigate the “Bloody Sunday” incident. He recalls: Lord Widgery....said [the soldiers] had reason to believe they had to shoot in self defense. From my own investigation I learned that nobody in the crowd had a gun. Some stones were thrown and the soldiers claimed they thought the stones were bombs with smoking wicks, but certainly there could be no lighted wick with smoke coming from stones.... I ordered a transcript of the full testimony and got hundreds of eyewitness statements. Because I had all the evidence, the International League asked me to write a report. I wrote Justice Denied.... The British Broadcasting Company called me from London and the reporter wanted to ask me questions.... “Is it true that you teach at Georgetown, a Jesuit school?” he asked. I said, “Yes, I do.” He said, “Being a Catholic, can we give you any credibility at all?” I said, “I'm Jewish, and Georgetown had nothing to do with my going to Northern Ireland.” He didn't have another question and said simply, “Well, thank you.” (Bar Report interview, August/September 1998) Largely as a result of Dash's independent review as put forth in Justice Denied, the British government in 1998 revisited the “Bloody Sunday” incident and, after a lengthy new investigation ab initio, reversed the Widgery report. All the victims were exonerated; none of the killings was found to have been justified. Currently it appears that only one other copy of Justice Denied in brand new condition is being offered elsewhere for sale, unsigned, at just over $1,000.
