The discs have significant scuffs and scratches but still work. I don't know if the serial has been used. The one thing to keep in mind that this is a Windows Live game disc. Because of that there may be issues and you may need to find work arounds due to the service no longer being in existence. Keep this in mind as this is an issue with all Windows Live games.
